Personal Data and General Confidentiality Agreement

This Personal Data and General Confidentiality Agreement ("Agreement") governs the treatment and protection of personal data and confidential information provided by the parties in the course of their relationship. This Agreement applies to all interactions and exchanges of information between HostWeGo ("Provider") and its clients ("Client") in the Balkan countries.

1. Personal Data Handling

1.1 HostWeGo agrees to handle personal data provided by the Client with the utmost care and in compliance with applicable data protection laws.

1.2 The Client agrees to provide accurate and up-to-date personal data required for the provision of services by HostWeGo.

1.3 Personal data shall only be used for the purpose of providing the agreed-upon services, unless otherwise agreed by both parties or required by law.

1.4 HostWeGo shall implement reasonable security measures to protect personal data from unauthorized access, disclosure, or loss.

2. Confidentiality

2.1 Both parties agree to treat all information exchanged in the course of their relationship as confidential, including but not limited to technical, financial, and business-related information.

2.2 Confidential information shall not be disclosed to any third party without the express written consent of the disclosing party.

2.3 The obligation of confidentiality shall not apply to information that:

• Is already publicly known or becomes publicly known without breach of this Agreement.
• Is independently developed by the receiving party without reference to the disclosing party's confidential information.
• Is required to be disclosed by law or a government authority.

3. Data Breach Notification

3.1 In the event of a data breach affecting the Client's personal data, HostWeGo shall promptly notify the Client and take all reasonable measures to mitigate the impact of the breach.

3.2 The Client agrees to cooperate with HostWeGo and provide necessary assistance in resolving data breach incidents.

4. Data Retention

4.1 HostWeGo shall retain personal data for as long as necessary to fulfill the purpose for which it was collected or as required by applicable laws.

4.2 Upon the termination of the business relationship, HostWeGo shall, at the Client's discretion, return or securely dispose of all personal data.

5. Subcontractors and Third Parties

5.1 HostWeGo may engage subcontractors or third-party service providers to assist in providing the agreed services. HostWeGo shall ensure that such subcontractors are bound by confidentiality obligations equivalent to those in this Agreement.

6. Amendments

6.1 This Agreement may be amended or updated by mutual written consent of both parties.

By availing of HostWeGo's services, the Client acknowledges that they have read, understood, and agreed to be bound by the terms and conditions set forth in this Personal Data and General Confidentiality Agreement.
